Terms of Service
Draft prepared for review. Have it checked by a lawyer or a legal service before publishing. A French version is required for customers in France.
1. Who we are
The Order Flow Reader is operated by Rémi Chenu, sole trader (entrepreneur individuel) registered in France under SIRET 498 313 162 00030, contact: contact@theorderflowreader.com. In these terms, "we" means the operator and "you" means the customer.
Payments are processed by Paddle (Paddle.com Market Ltd), which acts as the merchant of record for your purchase. Its own buyer terms apply to the payment, billing, taxes and invoices. These terms govern your use of the software.
2. What we sell
We sell custom studies (software add-ons) for the Sierra Chart trading platform, a pre-configured chartbook, and the related videos and documentation. Sierra Chart itself, its subscription and your market data are not included and must be obtained from Sierra Chart Engineering and your data provider.
- Subscription: access to all current studies, their updates and any new study added to the suite while your subscription is active.
- Chartbook (ES Workspace): a one-time purchase of a pre-configured Sierra Chart chartbook. It is included with annual subscriptions.
3. Not investment advice
The studies display market data and calculations on your charts. They are tools for your own analysis. We do not provide investment advice, trade recommendations, signals, portfolio management or trading education. Nothing on this site, in the studies, the videos or our communications is an invitation to buy or sell any financial instrument.
Trading futures involves substantial risk of loss and is not suitable for every investor. You are solely responsible for your trading decisions and their results. Examples and illustrations show past market behavior and do not guarantee future results.
4. License
We grant you a personal, non-exclusive, non-transferable license to use the studies on the Sierra Chart account (username) you register with us, for as long as your subscription is active.
You may not:
- share, resell, sublicense or publish the studies, the chartbook or their files;
- let another person use your authorized Sierra Chart username to access the studies;
- decompile, reverse-engineer or attempt to bypass the license check, except where the law expressly allows it;
- use the studies to build a competing product.
The chartbook may be used on your own computers for your own trading, without time limit. Studies inside it that belong to the subscription only work while the subscription is active.
All rights in the studies, chartbook, videos, documentation and brand remain ours.
5. Free trial
New subscribers get a 7-day free trial, once per person and per Sierra Chart username. If you do not cancel before the end of the trial, your subscription starts and the first payment is taken. If you cancel during the trial, nothing is charged and the studies stop working at the end of the trial.
6. Subscription, renewal and cancellation
Subscriptions renew automatically at the end of each monthly or annual period at the price in force for your plan. You can cancel at any time from the link in your purchase email or your customer portal. Cancellation takes effect at the end of the period already paid; access continues until then.
Founding member price. If you subscribed at a founding member price, you keep that price for as long as your subscription stays active without interruption. If you cancel and subscribe again later, the price in force at that time applies.
We may change our regular prices. Any change for an existing subscriber is notified by email at least 30 days before it applies, and you can cancel before it takes effect.
7. Refunds and right of withdrawal
Refunds are handled under our Refund Policy.
If you are a consumer in the European Union, you normally have a 14-day right of withdrawal. Because the studies are digital content supplied immediately, at checkout you are asked to agree that access starts right away and to acknowledge that you lose the right of withdrawal once access has started (French Consumer Code, art. L221-28, 13°). The free trial lets you test the product before any payment.
8. Delivery and authorization
After sign-up we add your Sierra Chart username to the authorized users of the studies, usually within a few hours and at most within one business day. You receive the download links and installation guide by email.
9. Updates and availability
We maintain the studies for current versions of Sierra Chart and publish updates as they are ready. Studies may change, be improved, merged or replaced over time. We cannot guarantee that the studies will work with every Sierra Chart version, data feed or configuration, or without interruption, since they depend on a platform we do not control.
10. Support
Support is provided by email at contact@theorderflowreader.com for installation and use of the studies. It does not cover trading advice or the configuration of Sierra Chart beyond what the studies need.
11. Liability
The studies are provided as tools. To the extent permitted by law, we are not liable for trading losses, missed opportunities, data errors, platform outages or indirect damages arising from the use of the studies. Our total liability for any claim is limited to the amount you paid us during the 12 months before the claim. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
12. Suspension
We may suspend or end your access, without refund, if you breach the license (section 4), in particular by sharing the studies or your access. We will tell you by email first unless the breach is serious.
13. Personal data
We process your personal data as described in our Privacy Policy.
14. Changes to these terms
We may update these terms. Material changes are announced by email at least 30 days in advance. The version in force at the time of your purchase or renewal applies.
15. Law and disputes
These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of your country of residence. Before any legal action, contact us so we can try to solve the problem. Consumers in the EU can also use a consumer mediator: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris, France, phone +33 1 89 47 00 14 (Monday to Friday, 10:00 to 12:00), www.cm2c.net. You can also use the European Commission's consumer redress platform.
